Conveyancing
Conveyancing involves all the adminstrative and legal work involved in transferring ownership of property or land from one person to another.
The Seller’s Conveyancer will request a copy of the land registry entry for the property being sold.
A contract for sale will then be prepared which includes the land registry plan before sending it to the Buyer’s Solicitors.
The Buyer’s Solicitors will apply for searches and will assess the contract for sale.
The Solicitor will also need to receive a copy of the formal mortgage offer (if a mortgage has been applied for) and ensure that the Buyer has sufficient funds to complete the transaction.
Once all searches have been received, any issues resolved and proof of funds achieved, then Exchange of Contracts will be made.
Once Exchange of Contracts has been made both parties would have entered into a legally binding agreement for the Seller to buy and the Buyer to sell the property.
Neither party can withdraw once exchange has been made.
A completion date is normally agreed when the transfer has been finalised.
Monies are transferred and keys are handed over on the day of completion.
